Terms of Service

1. ACCEPTANCE OF TERMS

1.1 General Description

The following terms and conditions (this "TOS") govern all use of the ABM-Ticket website and the services and software available on or through the Site (taken together with the Site, collectively, the "Service"). The Service is owned and operated by ABM-Ticket ("ABM-Ticket"). The Service is offered subject to your acceptance without modification of all the terms and conditions contained herein and all other operating rules, policies, and procedures that may be published from time to time on the Site by ABM-Ticket.

1.2 Modification

ABM-Ticket reserves the right, in its sole discretion, to modify or replace any of the terms or conditions of this TOS at any time. It is your responsibility to check this TOS periodically for changes.

2. SERVICE DESCRIPTION

ABM-Ticket provides a simple and quick means for registered users who are event organizers and planners ("Organizers") to collect event registration fees from registered users who wish to attend such events ("Buyers") via the Internet. In order to use the Service, you must register with ABM-Ticket and represent and warrant that you are at least 18 years old and that you have the authority to bind the entity you represent to this Agreement.

3. PAYMENT AND REFUND POLICY

All sales are final. Ticket purchased through ABM-Ticket are non-refundable unless the event is canceled. In the event of cancellation, refunds will be processed according to the event organizer's policies.

4. USER OBLIGATIONS

  • You must be at least 18 years old to use the Service
  • You agree to provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account
  • You agree not to use the Service for any illegal or unauthorized purpose

5. SELLER AND ADMIN OBLIGATIONS

If you are using ABM Ticket - Admin mobile application for iOS or Android, you agree to the following additional terms:

  • You will accurately represent events, tickets, and venue information
  • You will not charge fees beyond those disclosed to buyers at the time of purchase
  • You will respond promptly to customer inquiries and disputes
  • You will comply with all applicable laws and regulations, including tax reporting requirements
  • You will not use the platform to sell tickets to illegal or unauthorized events
  • You will maintain accurate financial records for all transactions
  • You will properly secure any credentials provided to access the admin platform

5.1 Mobile Application Terms

The ABM Ticket - Admin mobile application for iOS and Android devices is subject to the following additional terms:

  • You acknowledge that these Terms constitute an agreement between you and ABM-Ticket, not with Apple Inc. or Google LLC
  • You agree to use the mobile application in compliance with the Apple App Store Terms of Service, Google Play Store Terms of Service, and any other applicable platform terms
  • You understand that ABM-Ticket, not Apple or Google, is responsible for addressing any claims relating to the application, including product liability claims, consumer protection claims, intellectual property claims, and legal or regulatory compliance claims
  • You acknowledge that Apple and Google have no obligation to provide maintenance and support services for the application
  • In the event of any third-party claim that the application infringes on intellectual property rights, ABM-Ticket, not Apple or Google, will be solely responsible for investigation, defense, settlement, and discharge of such claims

5.2 Device and Network Requirements

To use the ABM Ticket - Admin mobile application effectively:

  • You must have a compatible mobile device with internet access and a supported operating system version as specified in the application listing
  • You must ensure your device has sufficient storage space for the application and associated data
  • You are responsible for all data charges and fees incurred while using the application on cellular networks
  • You understand that the application's functionality may be limited if used offline or with a poor internet connection
  • You acknowledge that updates to the application may be required periodically and failure to update may limit functionality or access to services

5.3 In-App Features and Transactions

When using the ABM Ticket - Admin mobile application:

  • You may access features for scanning tickets, managing events, and processing transactions
  • You must ensure proper handling of customer data during ticket scanning and validation
  • You agree to implement appropriate security measures when handling payments or sensitive customer information
  • You understand that certain features may require additional hardware such as barcode scanners or receipt printers
  • You acknowledge that in-app analytics and reporting features are provided for business purposes only and should not be used for tracking individual customers outside the scope of ticket verification

5.4 Mobile App Permissions

The ABM Ticket - Admin mobile application requires certain device permissions to function properly:

  • Camera: Required for scanning QR codes and barcodes on tickets, as well as taking photos of event setups or issues that require documentation
  • Location: Used to verify event check-ins, provide location-based features, and prevent fraudulent activities
  • Storage: Required to save tickets, event information, and transaction records locally for offline access
  • Network Access: Required to synchronize data with ABM Ticket servers and process transactions
  • Bluetooth: May be used to connect to ticket printers or other peripherals
  • Push Notifications: Used to alert you about important event updates, security issues, or transaction confirmations

By installing and using the application, you consent to these permissions. You can manage permissions through your device settings, but limiting certain permissions may affect the functionality of the application.

6. INTELLECTUAL PROPERTY

The Service and its original content, features, and functionality are owned by ABM-Ticket and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not duplicate, copy, or reuse any portion of the HTML/CSS, Javascript, or visual design elements or concepts without express written permission from ABM-Ticket.

7. DATA PRIVACY

ABM-Ticket collects and processes personal data as described in our Privacy Policy. For Sellers and Admins, additional data processing requirements apply:

  • You may access user data only as necessary to fulfill your obligations
  • You must maintain confidentiality of all user data and not disclose it to third parties
  • You must implement appropriate security measures to protect user data
  • You must delete user data when no longer needed for legitimate business purposes
  • You must comply with all applicable data protection laws and regulations

8. LIMITATION OF LIABILITY

ABM-Ticket shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the Service. This includes but is not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or inability to use the service.

9. TERMINATION

ABM-Ticket reserves the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of the Terms. For sellers and admins, termination may result in the immediate removal of all event listings and access to the admin platform.
